What are the tax implications of rental income from investment properties in India?

Rental income from investment properties is taxable under the Income Tax Act in India. You can claim deductions on interest payments, property taxes, and maintenance expenses.  Tax Treatment of Rental Income


Gross Annual Value (GAV):

  • The total rent received or receivable from the property in a financial year is considered as the Gross Annual Value (GAV). If the property is vacant for a part of the year, GAV is calculated as the rent for the occupied period.

Net Annual Value (NAV):

  • NAV is calculated by deducting the municipal taxes paid (such as property tax) from the GAV. It represents the effective income from the property.

Deductions:

  • Standard Deduction: A standard deduction of 30% of the NAV is allowed to cover repairs, maintenance, and other expenses, irrespective of the actual amount spent.

  • Interest on Home Loan: The interest paid on a home loan for purchasing, constructing, or renovating the property is deductible under Section 24(b). The maximum deduction allowed for a self-occupied property is ₹2,00,000 per annum. For a let-out property, there is no upper limit, but the overall loss from house property that can be set off against other income heads is capped at ₹2,00,000 per annum. The remaining loss can be carried forward for up to 8 years.

Additional Considerations


Pre-construction Interest:

  • Interest paid during the construction period can be claimed in five equal installments starting from the year in which the construction is completed.

Joint Ownership:

  • If the property is jointly owned, rental income and home loan interest can be proportionately divided among the co-owners, based on their ownership share.

Carry Forward of Losses:

  • If deductions exceed the rental income, resulting in a loss under the head "Income from House Property," the loss can be set off against other income heads up to ₹2,00,000. The remaining loss can be carried forward for up to 8 years to be set off against future house property income.

Tax Benefits for NRIs:

  • Non-Resident Indians (NRIs) earning rental income from properties in India are subject to the same tax rules. They must file ITR-2 and can claim the same deductions under Section 24(b).
